The Attorney Who Became a Brother! I was falsely accused of assault with a deadly weapon and four other charges after defending myself in an altercation. The other person pulled a gun on me, attacked me, and fell on his face during the struggle. He then falsely claimed I threw a large rock at him. I hired an attorney (not James Merson) and didn’t want to take a plea deal because I was innocent. After two years of attempts, my attorney never got an offer from the D.A. To be fair, the delay was due to the D.A.’s maternity leave, and communication was pretty bad even after she came back. Maybe because she was catching up on all the other cases? Either way, my attorney didn’t know my case. When we had meetings he wouldn’t even remember the basic details. Once, he thought I wasn’t charged with bodily injury, but I corrected him, I knew my case like the back of my hand and I knew I had this report and he spent the rest of the meeting looking for it. I tried to give him the benefit of the doubt and say to myself, “He is not a computer to remember everything”. And also, he has other cases. Even though he didn’t remember the details of my case, he repeatedly pushed me to accept a plea deal if offered one. After 2½ years, we finally set a trial date. But two weeks before trial I got a call from my attorney on a Sunday evening letting me know that he was quitting on me without a reason. We never argued or anything and he was paid in full. Now without an attorney, the D.A. was pushing for felonies. I felt betrayed, wondering if attorneys and D.A.s worked together to pressure people into plea deals. At this point, I could either take the plea deal or I could hire another attorney. I knew I did not commit this crime so I decided to roll the dice and continue fighting for my innocence.

I talked to so many attorneys and the one that stood out was James Merson. On our call he would really listen to me and give me his opinion about the facts of the case. I was skeptical because of my experience with my first attorney. But as time went on, everything was the opposite. James remembered the details of my case. He would tell me that it was up to me if I wanted to go to trial. He told me the risks but he never talked me into anything. He would tell me that if he knew I had a bad case he would try to prevent me from going to trial. But he would tell me that he believed me and that he studied the case and it was a defensible case. Around 6 months James negotiates with the D.A and gets me a great deal with probation and a misdemeanor. I decline and James prepares us for trial. This man looked like he lost sleep preparing for me and took the trial so personal. Throughout the trial James was not only a great intelligent lawyer but a therapist and a great friend! Going through trial had to be the hardest thing I have ever gone through in my entire life! The last day of trial as we are waiting for the verdict James tries to keep my mind off of it and shows me a shot that the Nikola Jokić (the Joker) from the Nuggets took from the other side of the court on his laptop. Finally the Jury walks in and I am found not guilty on all charges. I broke down and tears fell down my face! James was Nikola Jokić in my case! As I lost hope in the legal system, attorneys and even humanity. James shot the ball from the other side to bring that faith back. I will always be grateful for James! After the verdict we celebrated and I remember telling him, “has anyone ever told you that they owe you 10-32 years of their life”? I want you to know that I truly mean that my friend! If you ever need anything, I am here! If you are looking for someone that will fight for you, someone that will take your freedom seriously! Hire James Merson!
